Virginia Police Commissioned to Create Child Porn

In order to enforce laws that treat vices as if they were crimes, the police are given great latitude to engage in proscribed behavior in order to prosecute those who don’t enjoy the same privileges. Thus undercover narcotics officers are allowed to purchase and even to consume narcotics, vice enforcement officers are permitted to engage in sexual conduct during prostitution stings, and at least one police agency has been authorized to create child pornography in order to prosecute a teenager accused of that offense.

Prosecutors in Virginia’s Prince William County have persuaded a judge to issue a warrant allowing police to take a photograph of a 17-year-old male’s erect penis “to compare against photos he is accused of sending to his 15-year-old girlfriend,” reports the AP. In order to create these images, the police plan on taking the teenager to a hospital “and injecting him with a chemical that would cause an erection.” The young man’s legal guardian has sent him out of state in order to prevent him from being kidnapped and forced to undergo something tantamount to aggravated sexual assault and torture. Until and unless the warrant is vacated, that young man will be the contemporary equivalent of a fugitive slave, vulnerable to abduction and delivery to people who claim ownership of his body.

The mother of the young man’s girlfriend filed a complaint last January after finding what she described as “pornographic videos” on the girl’s cell phone. Prosecutors demanded that the boy accept a plea deal that would have placed him on probation for a year and forbidden him to use the internet or his cell phone — and be subject to felony charges and mandatory registration as a sex offender if he used social media even once. The boy rejected the deal, and in a transparently punitive response prosecutors demanded what amounts to a sexual torture warrant. The boy now faces two felony charges and the prospect of imprisonment and lifetime registration as a sex offender.

With increasing frequency, police across the soyuz are conducting assaults on the bodily integrity of citizens in pursuit of self-incriminating evidence– from forced blood draws and catheterization of DUI suspects, to forced colonoscopies and enemas inflicted on people suspected of smuggling drugs. Often, as with the recent case in Virginia, those procedures are carried out in a vulgar exercise of retaliation against a Mundane who dares to assert his rights. None of this is even remotely compatible with the due process protections supposedly provided by the Fourth and Fifth amendments, as if such archaic concepts had any relevance under our present system of scalable totalitarianism.
